    Keeping your data safe

    This privacy notice is to let you know how KRONE UK Ltd promise to look after your personal information. This includes what you tell us about yourself, what we learn by having you as a customer, and the choices you give us about what marketing you want us to send you. This notice explains how we do this and tells you about your privacy rights and how the law protects you.

    We promise:

    • To keep your data safe and private.

    • Not to sell your data.

    • To give you ways to manage and review your marketing choices at any time.

    As well as our Privacy Promise, your privacy is protected by law. This section explains how that works.  Data Protection law says that we are allowed to use personal information only if we have a proper reason to do so. This includes sharing it outside KRONE UK Ltd. The law says we must have one or more of these reasons:

    • To fulfil a contract we have with you, or

    • When it is our legal duty, or

    • When it is in our legitimate interest, or

    • When you consent to it.

    A legitimate interest is when we have a business or commercial reason to use your information. But even then, it must not unfairly go against what is right and best for you. If we rely on our legitimate interest, we will tell you what that is.

    1 Who’s in control

    1.1 It is important that you understand who is responsible for keeping your data safe. We are the ‘controller’ of all personal data collected which means we are responsible for deciding how and why your data is used. We also ensure that your data is handled legally and safely.

    1.2 We have appointed a Data Protection Officer (DPO) who has ultimate responsibility within KRONE UK for making sure your data is treated in accordance with this Privacy Policy and the law.

    2 Types of Personal Information

    2.1 We use many different kinds of personal information, and group them together as stated below.

    Contact

    Where you live and how to contact you.

    Socio-Demographic

    This includes details about your work or profession e.g. Farm Manager, Student, Driver etc, your farm size and the industry you work in.

    Product

    Details about the products or services you have bought or have expressed interest in from our dealerships or other companies such as JCB Finance who have obtained your permission to share data with us.

    Locational

    Data we get about where you are, such as may come from your mobile phone or the address where you connect a computer to the internet.

    Behavioural

    Details about how you use our products and services such as what type of farm operation e.g. Livestock, Hay & Straw, Arable etc.

    Technical

    Details on the devices and technology you use such as how you access our website.

    Communications and Survey Data

    What we learn about you from letters, emails and conversations between us.

    Consents

    Any permission, consents, or preferences that you give us. This includes things like how you want us to contact you and when you gave us consent.

    Voluntary Data

    We also collect information that you voluntarily provide to us when you contact us with queries, complaints, comments or praise, or information that you voluntarily post about yourself on public areas.

    Competition Data

    We collect information about you when you participate in competitions, such as your contact information. This data is only used for the purposes of the relevant competition and will be subject to the terms and conditions of that competition.

    3 How we use your personal information

    3.1 Below is a list of all the ways that we may use your personal information, and which of the reasons we rely on to do so. This is also where we tell you what our legitimate interests are.

    3.2 Managing your relationship with us and providing you with our services

    3.2.1 Managing your relationship with us and providing you with our services such as warranty contracts whilst ensuring our records are up to date.

    3.2.2 We use your Contact Data to contact you occasionally with important updates about KRONE UK and any products you may own.

    3.2.3 We use your Voluntary Data to enable us to respond to queries, complaints or comments that you have and to make sure that these are appropriately dealt with.

    3.3 Competitions

    3.3.1 We use Competition Data for the purposes of allowing you to participate in competitions and to carry out activities required in relation to those competitions e.g. contacting you to let you know you have won a prize and using your address to send your prize to.

    3.3.2 We use Survey Data for the purposes of analysing insights and information to enable us to improve our services and products. 

    3.4 Improving our Products and Services

    3.4.1 We use your Product Data, Behavioural Data, Voluntary Data and Demographic Data to help develop new ways to meet our customers’ needs and to grow our business. We study how our customers use products and services from us and other organisations such as JCB finance and our dealerships.

    3.5 Marketing and Advertising

    3.5.1 We use Contact Data, Socio-Demographic Data, Product Data, Behavioural Data, Communications and Survey Data for marketing and advertising purposes. This can include sending you tailored marketing messages. For more information on the ways in which we do this, please see the section on ‘How do we use your data for marketing and advertising purposes?’ below.

    4 How do we use your data for marketing and advertising purposes?

    4.1 We may use your personal information to tell you about relevant products and offers. This is what we mean when we talk about marketing. The personal information we have for you is made up of what you tell us, and the data we collect when you use our services, or from third parties we work with. We study this to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you.

    4.2 We can only use your personal information to send you marketing messages if we have either your consent or a ‘legitimate interest’ that is when we have a business or commercial reason to use your information. It must not unfairly go against what is right and best for you.

    4.3 Email Marketing

    4.3.1 We will use your e-mail address to send you e-mail marketing such as newsletters, information on your current products, information about new product and products you may be interested in, offers and finance deals, product tips and annual shows and events where you have signed up to receive this from us.

    4.3.2 You can opt out of receiving marketing e-mails at any time by following the instructions to unsubscribe in any of our email marketing communications. It may take up to 48 hours for your change in preference to take effect.

    4.3.3 If you opt out of email marketing, we may still need to e-mail you from time to time to respond to communications from yourself or if you took part in a competition/ factory trip etc.

    4.4 You can ask us to stop sending you marketing messages by contacting us at any time. Whatever you choose, you’ll still receive important information such as warranty certificates.

    4.5 We may ask you to confirm or update your choices if you order any new products with us in the future. We will also ask you to do this is there are changes in the law, regulation, or the structure of our business.

    5 What is our legal basis for using your data?

    5.1 Data protection law says that we have to tell you the legal basis that we rely on to process your personal data for the purposes that we have notified to you. This section tells you what that legal basis is in relation to each of the purposes set out above.

    5.2 With the exception of email marketing, we process your personal data for all the purposes identified under ‘What do we use your data for?’ and ‘How do we use your data for marketing and advertising purposes?’ above on the basis that is in our legitimate interests to carry out these activities. Further information about what those interests are is set out below.

    Purpose: Managing your relationship with us and providing you with our services.

    Legitimate interests: To ensure that customer records are kept up to date so we can refer back to them if there is a problem and store warranty contract information.

    Purpose: Improving our products and services

    Legitimate interests: To make sure that we continue to improve our product range and relationships with our customers through us and our dealerships. 

    Purpose: Marketing 

    Legitimate interests: To provide marketing communications that are relevant to you to ensure that you have the best experience possible with KRONE UK and to generate more revenue that we can put back into developing our products and services.

    5.3 You have the right to object to us processing your personal data for the purposes set out above. Unless we can show that we have a compelling legitimate reason to continue processing your personal data, we will stop processing it. 

    5.4 In your respect of the use of your email address for email marketing purposes, we process this on the basis that we have your consent to do so. You can withdraw your consent at any time by following the instructions to unsubscribe in any email marketing communications.

    6 Who we share your personal information with

    6.1 We do need to share your personal data with some third parties in some circumstances. This includes where we use third party supplies to perform various services for us. The third party suppliers we share your personal data with are as follows:

    6.1.1 third party service providers who help us manage our dealership and customer database 

    6.1.2 Your data is also shared to us by JCB Finance Ltd who send us the data to allow us to see what machine is owned by who. This reinforces the data we already have from our warranty process. We will never receive any sensitive financial data from JCB Finance just Contact Data and Product Data.

    6.2 We will also share your personal data with third parties in the following circumstances:

    6.2.1 Where you have specifically consented to us sharing your data with a particular third party

    6.2.2 Where we are required or permitted to do so by law or to protect or enforce our rights or the rights of any third party.

    7 How long we keep your personal information

    7.1 We will keep your personal information for as long as you are a customer of a KRONE UK dealership.  After you stop being a customer, we may keep your data for up to 10 years for one of these reasons:

    7.1.1 To show that we treated you fairly

    7.1.2 To maintain records according to rules that apply to us.

    7.1.3 To respond to any questions or complaints.

    7.2 We may keep your data for longer than 10 years if we cannot delete it for legal, regulatory or technical reasons. We may also keep it for research or statistical purposes. If we do, we will make sure that your privacy is protected and only use it for those purposes.

    8 What rights do you have?

    8.1 You have a number of rights under data protection law. These rights and how you can exercise them are set out in this section. We will normally need to ask you for proof of your identity before we can respond to a request to exercise any of the rights in this section and we may need to ask you for more information, for example to help us to locate the personal data that your request relates to.

    8.2 We will respond to any requests to exercise your rights as soon as we can and in any event within one month of receiving your request and any necessary proof of identity or further information. If your request is particularly difficult or complex, or if you have made a large volume of requests, we may take up to three months to respond. If this is the case, we will let you know as soon as we can and explain why we need to take longer to respond.

    8.3 A right to access your information

    8.3.1 You have a right to object to us processing any personal data that we process where we are relying on legitimate interests as the legal basis of our processing. This includes all of your personal data that we process for all of the purposes set out in the Privacy Policy.

    8.3.2 If we have legitimate grounds to carry on processing your data, we will be able to continue to do so. Otherwise, we will cease processing your personal data.

    8.3.3 You can exercise this right by contacting our Data Protection Officer through the address given later on in this document.

    8.4 A right to ask us not to market to you

    8.4.1 You can ask us not to send you direct marketing by unsubscribing on any of our email marketing communications.

    8.5 A right to have inaccurate data corrected

    8.5.1 You have a right to ask us to correct inaccurate data that we hold about you. If we are satisfied that the new data you have provided is accurate, we will correct your personal data as soon as possible.

    8.6 A right to have your data erased

    8.6.1 You have a right to ask us to delete your personal data in certain circumstances, for example if we have processed your data unlawfully or if we no longer need the data for the purposes set out in this Privacy Policy.

    8.7 A right to have processing of your data restricted

    8.7.1 You can ask us to restrict processing of your personal data in some circumstances, for example if you think the personal data is inaccurate and we need to verify its accuracy, or if we no longer need the data but you require us to keep it so that you can exercise your own legal rights.

    8.7.2 Restricting your personal data means that we only store your personal data and don’t carry out any further processing on it unless you consent or we need to process the data to exercise a legal claim or to protect a third party of the public.

    10 How to complain

    10.1 Please let us know if you are unhappy with how we have used your personal information. You can contact us by writing to our Data Protection Officer.

    10.2 You also have the right to complain to the Information Commissioner’s Office, which regulates data compliance in the UK, if you are unhappy with how we have processed your personal data. Find out on their website how to report a concern.

    11 Future formats for sharing data

    11.1 We may make changes to this Privacy Policy from time to time. Any changes we make will be posted on this page. We may also notify you by email if significant changes are made.
